'The (infamous) question of punitive damages in EU competition law.'
Global Competition Litigation Review, 9 (3).
pp. 88-95.
Abstract
Examines the desirability of EU law permitting the award of punitive damages in private antitrust cases. Discusses why this was proposed by the European Commission in a 2005 Green Paper. Assesses the purpose of private enforcement and whether punitive damages would be compatible with that aim. Considers the risk that punitive awards would deter pro-competitive conduct. Reviews other options for incentivising private enforcement claims.
