Abstract
Under Turkish Law, the protection of consumers has been constitutionally guaranteed in Article 172 of the Constitution of 1982, which stated that the State shall take measures to protect and enlighten consumers and encourage them to take initiatives to protect themselves. In this respect, consumer protection rules ensure consumers fair treatment, goods and services that meet acceptable standards and a right of redress if their rights are infringed. Services, which do not start within the timeframe specified in the contract or which lack the characteristics that either are agreed upon by the parties or should they objectively have, are called defective services and these services constitute one of the areas where consumers enjoy protection. That said, the literature and decisions of the Court of Cassation show that there has been an ongoing debate over what constitutes services. It is important to determine what the service is in order to identify whether a defective service would be included in the scope of the Consumer Protection Act no. 6502. This article will discuss the need for and importance of the protection of consumers, what services mean, how to define defective services, what kind of services can be regarded as defective under the Consumer Protection Act no. 6502, what the responsibility of service providers of defective services and, finally, consumers’ rights against defective services.
