Abstract
Divorce due to de facto separation, which allows spouses who have been living apart for a certain period and no longer share a common life to legally terminate their already de facto ended marriage, is regulated as a single paragraph under Article 166 of the Turkish Civil Code. The recognition of de facto separation as a ground for divorce in Turkish law for the first time caused significant debates, and criticisms of the regulation continued even after its adoption. Within the framework of the Turkish Civil Code, in cases where spouses cannot divorce by mutual agreement, divorce due to de facto separation stands out as an important provision in the face of the strict conditions of other grounds for divorce. This book examines divorce due to de facto separation, which has not previously been the subject of any monographic work. The aim of the book is to evaluate the legal background and conditions of divorce due to de facto separation within the framework of doctrinal opinions and judicial decisions and to provide solutions to the problems arising from the regulation of de facto separation.
